DOL Updates MHPAEA Self-Compliance Tool

DOL Updates MHPAEA Self-Compliance Tool

Under the 21st Century Cures Act, Congress directed federal regulators to issue a guidance document to help group health plans and health insurers comply with the Mental Health Parity and Addiction Equity Act (MHPAEA), and to update this guidance document every two years.  Per that directive, the Departments of Labor (DOL), Health and Human Services (HHS), and Treasury created an MHPAEA Self-Compliance Tool.  It was last updated in 2018.

A few months ago in June 2020, the DOL had requested public comment on some proposed changes to the tool.  The goal was to incorporate updated guidance from FAQ Part 39, update the examples, and incorporate additional ideas on how to correct potential problem areas.  Based on the public comments and feedback received, they have now finalized updates to the Self-Compliance Tool.

IMA will continue to monitor regulator guidance and offer meaningful, practical, timely information.
