BCBSA Class
Action Lawsuit:
Settlement Update

After many years of court actions, claimants are finally starting to receive communication from the BCBS Settlement Fund administrators. It appears as though funds will be distributed in the near future, but that date is not posted on the BCBS settlement website.

According to the website, claim determination notices are being emailed on a rolling basis. Those who filed a claim before the 11/5/2021 (yes, 2021!) deadline will receive email communication sent to the email address that was provided in 2021.

  • Reminder: Claimants included individuals, insured groups or self-funded accounts that purchased or were enrolled in a BCBS health insurance or administrative services plan during certain dates.

As of this writing, IMA Compliance has confirmed several claimants have received an email that includes the claim number and PIN needed to access and review the total premiums. The email includes information on the following:

  1. Ability to dispute the total premiums paid and/or total administrative fees paid – 30 days from the date the notice is sent
    • When the claimant clicks on the link in the email communication, they will be sent to a webpage with a calculation of total premiums paid by the claimant.

  2. The claim notice email goes on to state that the claimant can opt for the first round of payments by choosing to receive their claim amount in the form of an electronic debit card. The link in the email will take you to the webpage to review and/or dispute premiums and opt in for the electronic debit card.
