CMMC 2.0 (effective Nov. 2025)

All DoD Contractors Handling FCI or CUI​

Level 2+ requires C3PAO third-party assessment every 3 years. Non-compliance blocks contract award.​

Assess level now; begin C3PAO preparation if Level 2. Cyber insurance must align to regulatory exposure.

FAR Subpart 28.3

All Government Contractors​

Government can require or disapprove specific coverage. CAS 416 contractors must carry insurance for all exposed peril.​

Review each contract’s insurance requirements clause before award. Build compliance matrix.​

DFARS / ITAR flow-down

Prime and Subcontractors on DoD Contracts​

Insurance, cyber, and export control obligations flow to the entire supply chain. Subcontractor non-compliance creates prime liability.

Vet subcontractors for insurance and ITAR compliance. Include insurance requirements in subcontracts.​

CSLA / FAA Launch Licensing

Commercial Launch Operators​

MPL-based third-party liability insurance is required as a condition of launch license. Government indemnification applies above insured layer.​

Engage launch insurance market and FAA early. Insurance must be in place before license is granted.​

Space Policy Directive-5 (Cyber)

Space System Operators​

Establishes cybersecurity-by-design principles for space assets. Cyber insurance should address ground and space segments.​

Align cyber policy scope to SPD-5 requirements. Include ground-system, command link, and mission data exposures.​

DBA / WHCA

Contractors with Overseas Personnel on DoD Contracts​

Workers’ compensation for overseas employees is mandatory; war-hazard coverage applies in conflict zones.​

Purchase DBA coverage before deploying personnel under international DoD contracts.

DoD Executive Order (Jan. 2026)

Major Defense Contractors​

Performance accountability now extends to corporate governance. Underperformance may trigger board-level remediation requirements.​

Ensure D&O coverage addresses regulatory investigation and government enforcement scenarios.​
