Any claim related to employment issues, including allegations of harassment, discrimination, wrongful termination, or other workplace practices.
Duties in the Event of A Claim
If a claim is made or suit is brought against any Insured, under the terms of the policy, you are required to report the claims as soon as practicable but in no event later than 60 days post policy term (or cancellation date).In accordance with the policy terms and conditions, RSUI provides the below claim reporting email. The claims reporting guidelines also include a “CC” of the claim to be sent to Craig Annunziata with Fisher & Phillips (the defense firm) and IMA.

- Immediately send copies of any demands, notices, summonses, or legal papers received in connection with the Claim.
- Cooperate with RSUI in the investigation, settlement or defense of the Claim.
- Assist RSUI, upon their request, in the enforcement of any right against any person or organization, which may be liable to any insured because of injury or damage to which this insurance may also apply.
- Panel Counsel Requirement:RSUI has the right and duty to defend any Claim to which this insurance applies. There is a provision(rider) on the policy that dictates Fisher & Phillips shall defend ALL claims for the Sonic Franchise Employment Practices Liability Program.
Non-Urgent Issues
Fishers & Phillips encourages the use of their toll-free hotline for risk management/mitigation questions or situations that are NOT URGENT in nature (i.e, state). What Constitutes as a Claim?
Written demand for monetary or non-monetary relief.
Civil, criminal, administrative, regulatory or arbitration proceeding for monetary or non-monetary relief.
- Service of a complaint or similar proceeding(i.e. EEOC charges, federal or state agency, etc.);
- Return of an indictment or filing of information; or,
- Receipt of a notice of charges.
An administrative or regulatory investigation, when conducted by the EEOC or equivalent state, local or foreign agency, which is commenced by the filing of a written request to an Insured to toll or waive the statute
of limitations regarding a potential claim.
