Any claim related to employment issues, including allegations of harassment, discrimination, wrongful termination, or other workplace practices.
Duties in the Event of A Claim
If a claim is made or suit is brought against any Insured, under the terms of the policy, you are required to report the claims as soon as practicable but in no event later than 60 days post policy term (or cancellation date).In accordance with the policy terms and conditions, Nationwide provides the below claim reporting email. The claims reporting guidelines also include a “CC” of the claim to be sent to Craig Annunziata with Fisher & Phillips (the defense firm) and IMA.

- Immediately send copies of any demands, notices, summonses, or legal papers received in connection with the Claim.
- Cooperate with Nationwide in the investigation, settlement or defense of the Claim.
- Assist Nationwide, upon their request, in the enforcement of any right against any person or organization, which may be liable to any insured because of injury or damage to which this insurance may also apply.
- Panel Counsel Requirement: Nationwide has the right and duty to defend any Claim to which this insurance applies. There is a provision(rider) on the policy that dictates Fisher & Phillips shall defend ALL claims for the Sonic Franchise Employment Practices Liability Program.
Non-Urgent Issues

What Constitutes as a Claim?
Employment Practices Claim means:
- a. a written demand against an Insured for damages or other relief;
- b. a civil, judicial, administrative, regulatory or arbitration proceeding or a formal governmental investigation against an Insured seeking damages or other relief, commenced by the service of a complaint or similar pleading, including any appeal there from;
- c. a civil proceeding against an Insured before the Equal Employment Opportunity Commission or any similar federal, state or local governmental body, commenced by the filing of a notice of charges, investigative order or similar document; or
- d. a criminal proceeding brought for an Employment Practices Wrongful Act in a court outside of document or receipt or filing of a notice of charges; brought by or on behalf of an Employee in their capacity as such. Employment Practices Claim does not include a labor or grievance proceeding, which is pursuant to a collective bargaining agreement
