Duties in the Event of A Claim



  • Immediately send copies of any demands, notices, summonses, or legal papers received in connection with the Claim.
  • Cooperate with RSUI in the investigation, settlement or defense of the Claim.
  • Assist RSUI, upon their request, in the enforcement of any right against any person or organization, which may be liable to any insured because of injury or damage to which this insurance may also apply.
  • Panel Counsel Requirement:RSUI has the right and duty to defend any Claim to which this insurance applies. There is a provision(rider) on the policy that dictates Fisher & Phillips shall defend ALL claims for the Sonic Franchise Employment Practices Liability Program.

What Constitutes as a Claim?
  • Service of a complaint or similar proceeding(i.e. EEOC charges, federal or state agency, etc.);
  • Return of an indictment or filing of information; or,
  • Receipt of a notice of charges.
