1.   Introduction

You have arrived at a website operated by IMA Financial Group, Inc., or one of our subsidiaries or affiliates (“IMA,” “we”, “our” or “us”). We are integrated financial services companies focused on protecting assets of our widely varied client base through insurance, risk management and wealth management solutions.

This Privacy Notice (“Notice”) describes the types of Personal Information that we may collect, how we may use it, how and when may we share it, and the rights you may have with respect to Personal Information about you. It also explains how we may communicate with you and how you can make inquiries and requests to us. For the purpose of this Notice, “Personal Information” means any information relating to an identified or identifiable individual that is protected by applicable privacy laws.

2.   Scope

This Notice applies when you use or access any of these websites and, to the extent applicable, their subdomains and/or portals, or otherwise provide Personal Information or interact with us on any of these sites (the “Sites”).

For the purpose of this Notice, “Personal Information” means any information relating to an identified or identifiable individual that is protected by applicable privacy laws. Our Sites may be used by our clients (“Clients”), individuals who are employees of our clients (“Client Employees”), individuals who use our Clients’ services (“End Users”), individuals who visit our Sites (“Site Visitors”), and individuals applying for employment with IMA (“Employment Applicants”).

By using the Sites, you agree to our Terms of Service.

Where applicable, we indicate whether and why you must provide us with Personal Information, and what happens if you do not do so. In some cases, if you do not provide Personal Information, you may not be able to benefit from our Sites if Personal Information is necessary to provide you with information or services requested, or if we are legally required to collect it.

3.   What Information We Collect

We may receive information (including Personal Information) in the following ways:

Information That You Provide to Us

As you interact with our Sites, we may collect Personal Information, including contact information (such as first and last name, job title, email address, fax number, home and/or shipping address, and/or phone number), in addition to other information, such as:

  • Information for us to respond to your requests and inquiries;
  • Information for us to send an email to your contact on your behalf (for example, to tell a friend or colleague about an IMA job listing), including your contact’s first and last name and email address, plus any message you may want to include;
  • Information to register you for an event, including contact information for all event attendees, and other information specific to the event (such as food selections and/or dietary restrictions, shirt or other clothing size(s), ages of participants, and preferred sessions or events to attend, etc.);
  • Information necessary to provide you an insurance quote, including insured information (such as date of birth, driver’s license or state identification number and state of issuance, gender, marital status, occupation, indication of past violations, and information about additional insureds), vehicle information (including make, model, VIN, features of the car, mileage, and anticipated mileage, etc.), and/or information about your home (address, occupancy, year built, size, number and type of rooms and amenities, upgrades, and renovations, etc.);
  • Information necessary for you to start a claim, such as date and type of incident;
  • Information associated with a request for an insurance certificate, such as information about the insurance (loan number, mortgage clause, name of unit owner, and unit number) and information about any additional insureds;
  • Information necessary to make a payment including account holder information, account information (credit card number, expiration date, and CVC; and/or account type, account number, and routing number), invoice number, and/or amount to be paid;
  • Information necessary for you to access a client portal, such as Google or Microsoft account credentials, username, email address, account number, other identifier, and password or other credential to authenticate your identity; and/or
  • Other information that could reasonably be used to identify you personally.

If you are an Employment Applicant and/or apply for a job via the Sites, any information we collect from you is subject to the Applicant Notice and Privacy Policy.

Information That Is Automatically Collected

Like many businesses, we and our service providers automatically collect and/or store certain information when you visit or interact with the Sites (“Usage Information”). This Usage Information may be stored and/or accessed from your computer, laptop, tablet, mobile phone, or other device (a “Device”) whenever you visit or interact with our Sites. The Usage Information we may collect includes:

  • Your Internet Protocol (“IP”) address, IDFA, Android/Google Advertising ID, IMEI, or another unique identifier;
  • Your Device functionality (including browser, browser language, settings and behavior, operating system, hardware, mobile network information);
  • Referring and exit web pages and URLs;
  • The areas within the Sites that you visit and your activities there, including remembering you and your preferences;
  • Your Device location or other location information, including the zip code, state, or country from which you accessed the Sites;
  • Your Device characteristics;
  • Certain other Device data, including the time of day you interact with our Sites, or other information used to provide analytics or other usage information;
  • Information about your engagement with our emails; and
  • Statistical information about how both unregistered and registered users, collectively, use the Sites. This aggregate information is derived from Personal Information but cannot be tied back to you or your web browser.

For location information, some of our Sites include features based on users’ actual locations and may report on users’ current locations (“Location-Based Services”). If you use Location-Based Services, we collect and store information about your location at the time you use those Location-Based Services (in addition to some automatically collected geolocation data). This information comes from a variety of sources depending on the device you use to access the Sites. For example, a mobile phone may report its GPS location at the time Location-Based Services are used.

If you do not wish for us or our service providers to collect and use location information, you may disable the location features on your device. Consult your device settings for instructions. Please note that if you disable such features, your ability to access certain features, Sites, content, promotions, or products may be limited or disabled.

Information Collected from Third Parties

The Sites may include functionality that allows certain kinds of interactions between the Sites and your account on a third-party website or application. The use of this functionality may involve the third-party site providing information to us. For example, we might obtain information about the traffic and usage of the Sites from third parties. We might also provide links to make it easier to send a communication from the Sites, or we may use third parties to make it easier to send emails or post to social media (like a “Share” or “Forward” button). These third parties may also use cookies and other tracking technologies to capture information about your interactions with the Sites.  IMA does not have control over the information that is collected, used, and shared by third parties. We encourage you to review the privacy statements of these third parties to understand their privacy practices.

4.   How We Use Personal Information

We may use Personal Information we collect about you in a variety of ways, including the following:

To Provide Our Sites

We may use Personal Information when you access or use our Sites, including to:

  • process and/or respond to your requests, including inquiries about and requests for products and services, insurance quotes, certificates of insurance, claim forms, etc.;
  • process payments;
  • create and verify user accounts and/or allow you to access our portal;
  • register you for an event;
  • deliver messages to you or your contacts;
  • facilitate the functionality of our Sites; and
  • customize experiences and personalization when you interact with our Sites.

To Communicate with You

We process certain information to communicate with you in relation to our products and services and to respond to your requests, including to:

  • communicate with you about requests, including request for a quote, certificate of insurance, or to start a claim;
  • respond to your customer service inquiries and requests for information;
  • send you personalized content and special offers, including to provide you with targeted advertisements or marketing communications we believe may be of interest to you;
  • communicate with you about our brands, products, events, or other promotional purposes;
  • implement your communications preferences, such as sharing information with our business partners so that they may email you about their promotions, products, and initiatives; and
  • provide important product and services information.

For Improvement of Our Sites

We want to ensure that our Sites are continually improving and expanding so that we meet and exceed your needs and expectations. To do so, we may process certain Personal Information, including to:

  • maintain, improve, and analyze our Sites; and
  • detect, prevent, or investigate suspicious activity or fraud.

To Comply with Applicable Laws

We may be required to process Personal Information under certain laws and regulations, such as tax laws, as well as to:

  • maintain appropriate records for internal administrative purposes; and
  • comply with applicable legal and regulatory obligations, and respond to lawful governmental requests, as needed.

To Enforce our Terms, Agreements, or Policies

To maintain a safe, secure, and trusted environment for you when you use our Sites, we may use Personal Information to ensure our terms, policies, and agreements with you and any third parties are enforced.

With Your Consent

We may process Personal Information for other purposes not specified in this Notice at your direction or with your consent.

5.   Use of Cookies

We may use cookies (small text files sent by your computer each time you visit our Sites) and other tracking technologies to personalize your experience, analyze user trends, and/or improve the Sites. These tracking technologies allow us to collect information such as your device type, browser type, interactions with our Sites, your web requests, the date and time of your web request, your IP address, the domain name of your Internet service provider, and other data. If you can be identified from this information – for example by combination with other pieces of information – or if we are otherwise required to do so by law, then we will treat this as Personal Information.

Many browsers default to accepting cookies. You may be able to change this setting in your browser and you can also clear your cookies. If you do, you may lose some functionality of our Sites.

We may use the following types of cookies:

  • Strictly necessary cookies. These cookies are essential for you to browse a website and use certain features, such as accessing secure areas of the website.
  • Functionality cookies. Also known as “preference cookies,” these cookies allow a website to remember choices you have made in the past, like what language you prefer, or what your username and password are so you can automatically log in.
  • Analytics cookies. Also known as “performance cookies,” these cookies collect information about how you use a website, like which pages you visited and which links you clicked on. Their sole purpose is to improve website function. This includes cookies from third-party analytics services if the cookies are for the exclusive use of the owner of the website visited.
  • Advertising cookies. These cookies track your online activity to help advertisers deliver more relevant advertising or to limit how many times you see an ad. These cookies share information with other organizations or advertisers. These are persistent cookies and almost always of third-party provenance.

We might also use pixel tags, which are small graphic files that allow us and third parties to monitor the use of the Sites and provide us with information based on your interaction with the Sites. These tags may collect the IP address of the device from which you loaded the page and the browser type. Pixel tags are also used by our third parties to collect information when you visit our Sites, the links, and other actions you take on our site. We may use this information in combination with cookies to display targeted advertisements.

6.   Your Choices

Cookies

You can opt-out of cookies by (a) enabling an opt-out preference signal or universal opt-out mechanism such as Global Privacy Control (GPC) on your browser, or (b) opting-out of cookies in our cookie preference center.

Do Not Track

Your browser may offer you a “Do Not Track” (“DNT”) option, which allows you to signal to operators of websites and web applications that you do not wish such operators to track some of your online activities over time and across different websites and platforms. There is no universally agreed-upon standard for what an organization should do when it detects a DNT signal. Universal Opt-Out Mechanism/Opt-Out Preference Signal

Some browsers and browser extensions support the Global Privacy Control (“GPC”) or other universal opt-out mechanism (“UOM”) that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales. In certain territories, when we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

An UOM allows consumers to exercise opt-out rights available under state laws.

Communication Preferences

With your consent, IMA communicates with you via a variety of print and digital media. To help us make emails more useful and interesting, we use pixels that enable us to see if you open emails from us, if your computer supports such capabilities. You can opt out of receiving emails from us at any time. Analytics

7.   How We Share Personal Information

Service Providers

We share Personal Information with our service providers who provide services such as website and/or form hosting, payment processing, online chat functionality, client portals, data analysis, information technology, customer service, email delivery, online advertising, auditing, event planning and registration, and other services.

Third Party Advertising

We share information about your use of our Sites, and your interaction with our ads on other websites, with our advertising partners to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We collect from and/or share with our advertising partners some of this information, and in some cases with cookies or other technologies (which you may consent to, depending on your location).

Aside from the instances described above, we may share Personal Information:

  • to comply with the law;
  • to respond to claims or comply with legal process served on IMA (e.g., a lawful subpoena, warrant, or court order);
  • to enforce or apply our policies or agreements;
  • to protect and defend our rights or property or that of our customers, employees, visitors, or the public;
  • in connection with a business transfer, sale, liquidation, or merger;
  • if we reasonably believe that an emergency involving immediate danger of death or injury to any person requires disclosure; and
  • to other parties with your consent.

8.   Third Party Links

Our Site may contain links to other websites such as social media platforms, other websites, and event and partner websites, for example. These websites are not covered by this Privacy Notice. Please review the Privacy Notices or Policies of those websites to understand their privacy practices.

9.   International Transfers of Personal Information

The Sites are operated and targeted toward audiences in the United States. If you are located in another jurisdiction, please know that your information will be transferred to, stored, and processed in the United States. By using the Sites and providing us with information, you consent to this transfer, processing, and storage of your information in the United States.

10.   Security

We seek to use reasonable organizational, technical, and administrative measures to protect Personal Information. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Where you use a password and/or other credentials to access certain areas of our site, you are responsible for keeping the password and/or credentials confidential. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us using the information in the Contact Us section below.

11.   Retention of Personal Information

IMA will retain Personal Information for as long as is necessary for the purposes set out in this Privacy Notice. We will retain and use Personal Information to comply with our legal obligations (for example, if we are required to retain Personal Information to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

All information you provide to us is stored on our servers or those of our data storage providers.

We have implemented measures intended to ensure that we will not retain Personal Information longer than is necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Note, however, that if we have a legitimate interest in retaining the data, or if we are required to do so by applicable law, we will retain the data in accordance with our data retention plans and policies.

In some circumstances we may choose to aggregate, de-identify, or otherwise alter data so that it can no longer be associated with an individual, either as an alternate to deletion or for using data for specific purposes, for example for research or statistical purposes, at which point it is no longer Personal Information. In these cases, we may use this information indefinitely without further notice.

When deciding how long to keep Personal Information, we consider:

  • How long we have had a relationship with you or provided our Sites to you;
  • Whether we are subject to any legal obligations (e.g., any laws that require us to keep transaction records for a certain period of time before we can delete them); and/or
  • Whether we have taken any legal positions (e.g., in connection with any statutes of limitation).

12.   Your California Privacy Rights

If you are an Employment Applicant and/or apply for a job via the Sites, any information we collect from you is subject to the Applicant Notice and Privacy Policy.

This section of our Privacy Notice applies to consumers who reside in California. We adopt this section to comply with the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and the regulations issued by the State of California (collectively, “CCPA”).

If you are a California resident, you may be able to exercise the following rights. We will honor requests we receive to the extent required by applicable law and within the time provided by law.

Right to Know and to Access Personal Information

You have the right to know, and to request that we disclose to you (i.e., access), the categories and/or specific pieces of Personal Information we have collected about you in the past twelve months. Specifically, you have the right to know, and to request that we disclose to you, the following:

  • The categories and specific pieces of Personal Information we collected about you;
  • The categories of sources from which the Personal Information was collected;
  • Our business or commercial purpose for collecting or selling the Personal Information;
  • The categories of third parties with whom we shared Personal Information;
  • The categories of Personal Information about you, if any, that we disclosed for monetary or other valuable consideration and the categories of third parties to which we disclosed the information;
  • The categories of Personal Information about you that we disclosed for a business purpose and the categories of third parties to which we disclosed the information; and
  • The categories of sensitive Personal Information that we collected, the purposes for which we collected or used them, and whether we sold or shared the sensitive Personal Information, except for such information that we collected or processed without the purpose of inferring characteristics about you.

Right to Deletion of Personal Information

You have the right to request that we delete Personal Information about you that we have collected from you.

As permitted by CCPA, if you request deletion of Personal Information that we have collected from you, we, our service providers, and our contractors may be unable to comply with such a request if the Personal Information is necessary to:

  • Complete the transaction for which the Personal Information was collected, provide a good or service requested by you or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you;
  • Prevent, detect, and investigate security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with section 1546) of Title 12 of Part 2 of the California Penal Code;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of that information is likely to render impossible or seriously impair the achievement to such research, if you have provided informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; or
  • Comply with a legal obligation.

Right to Correct Personal Information

You have the right to request that we correct any inaccurate information that we maintain about you.

Right to Opt-Out

You have the right to . We do not sell Personal Information, but we recognize that some privacy laws define “personal information” in such a way that making available identifiers linked to you in exchange for a non-monetary benefit may be considered a “sale.” Similarly, we may share Personal Information about you with a third party for targeted advertising.

Right to Limit the Use or Disclosure of Sensitive Personal Information

To the extent that we use or disclose Sensitive Personal Information for reasons other than those listed in the CCPA, you have the right to limit that use or disclosure of sensitive personal information.

We do not use Sensitive Personal Information for reasons other than those listed in the CCPA.

Right to Non-Discrimination

We may not discriminate against you because you have exercised any of these rights, including by:

  • Denying you goods or services;
  • Charging different prices or rates for goods or services, including through the use of discounts or other benefits, or imposing penalties;
  • Providing you a different level or quality of goods or services; or
  • Suggesting that you will receive a different price or rate for goods or services, or a different level or quality of goods or services.

We may offer you certain financial incentives. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value. Participation in a financial incentive program requires your prior opt-in consent, which you may withdraw at any time.

How to Exercise Your California Privacy Rights

You or your authorized agent may make a request to know and/or access, correct, or delete Personal Information, or request to opt out of the disclosure of Personal Information for business purposes. You may also make a verifiable consumer request on behalf of your minor child if you believe we have received Personal Information about a minor inadvertently. You may request to exercise these rights by:

Please note that we may take steps to verify your identity and residency before granting you access to information or acting on your request to exercise your rights. This might include asking for your email address. If you are requesting specific pieces of Personal Information that we have collected about you, you will also be required to email us at privacy@imacorp.com a signed declaration under penalty of perjury that you are a California resident and that you are the consumer who is the subject of the Personal Information request. Note that we will not process your request to disclose specific pieces of Personal Information we have about you until we receive this signed declaration.

If you use an authorized agent to exercise your rights, in addition to verifying your identity, we may require proof of written authorization you have given the authorized agent to make the request on your behalf.

We may limit our response to your exercise of the above rights as permitted by law. We will confirm receipt of the request and, if applicable, describe our verification process within 10 business days of receipt of the request. We will respond to your request within 45 days of receipt, or let you know if we need additional time.
